How it works

Share documents and define the charitable objects

We obtain DSCs, reserve the name and draft MOA, AOA and licence declarations

SPICe+ is filed with the licence request; MCA issues the licence and the Certificate of Incorporation with PAN and TAN

Timeline

15 to 25 working days. Government processing times are outside our control; we track and follow up on every application.

If you skip it

Penalty exposure: Breaching the licence conditions can attract a fine of Rs 10 lakh to Rs 1 crore on the company and up to Rs 25 lakh on each defaulting officer, and the licence can be revoked. Annual ROC filings carry Rs 100 per day late fees.

Frequently asked questions

Is there a minimum capital?

No. A Section 8 company can be formed with any capital, and there is no minimum paid-up amount.

Section 8 company, trust or society: which is better?

A Section 8 company is regulated by MCA, has the strongest governance and is generally preferred by CSR donors and foreign funders. Trusts and societies are cheaper to form but less uniform across states.

Is income automatically tax-free?

No. Exemption needs a separate registration with the Income Tax Department. We can file it right after incorporation.
